What is Judicial Separation? | General Legal Awareness
Many people believe Judicial Separation and Divorce are the same. However, under the Hindu Marriage Act, 1955, they are different legal remedies.
Under Section 10, Judicial Separation allows the Court to permit spouses to live separately while their marriage legally continues. The legal obligation to live together is suspended, but the marriage is not dissolved.
Key Points: ✔ It provides time for both spouses to reconsider their relationship and explore reconciliation. ✔ If both spouses wish, they may resume living together. ✔ If there is no resumption of cohabitation after the period prescribed by law following a decree of Judicial Separation, either spouse may file for divorce, subject to the applicable legal provisions. ✔ Depending on the facts and the law, either spouse may apply for Judicial Separation where the statutory grounds are satisfied.
